Most companies want to ensure that they take advantage of all government grants and assistance for which they qualify. Now, more than ever, companies need to become aware of which programs the governments are providing to business.

Generally speaking, we believe most of our clients who claim SR&ED tax credits, are more than likely eligible for other government assistance or programs. Ontario Business-Research Institute Tax Credit (OBRI)

Are You Getting The Benefits?

The Ontario Business-Research Institute Tax Credit (OBRI) is available to corporations that carry out research and development activities; surprisingly enough, many business owners and Executives are not aware of the significant tax savings that they can realize by tapping into this program.  There are some basic qualification criteria that need to be met, including the following:

  • The corporation must conduct business in Ontario through a permanent business establishment.
  • Legitimate research and development activities must have been carried out.
  • The company must have entered into a contract with a recognized research institute to conduct and implement the research and development activities for them.

If your corporation meets all of the above criteria, then you may well be eligible to obtain the Ontario Business-Research Institute Tax Credit (OBRI) and receive a 20% refundable tax credit up to a maximum of $4 million for scientific research and experimental development (SR & ED) expenditures incurred under a contract with an eligible research institute.  The best part is that even if you claim the Ontario Innovation Tax Credit (OITC, i.e.the Ontario R&D Tax Credit), the OBRI credit may be claimed in addition, which would result in a combined credit of 30% of your expenditures.

What do I have to do to claim this tax credit?

The corporation has ninety days from the execution of the contract to submit the claim to the Ministry of Finance.  You may ask, "how far back may I go"?  Unfortunately the Ministry is strict on deadlines, especially for firms who have made prior claims; however, they do make exceptions for first-time claimants. You need to prove to the Ministry that there were circumstances beyond your control (i.e.: you just became aware of the program, you changed accounting firms and were not advised of this program).  If you can show this, the Ministry will extend the deadline to three years from the execution of the contract.  If you are not allowed this extension and you have missed the ninety-day deadline, then they will only allow expenditures incurred after the date of your application.
